Tim McGraw and Faith Hill have been hit with a major lawsuit

Country superstars Tim McGraw and Faith Hill have been named as defendants in a federal copyright infringement lawsuit which claims their most recent hit single, “The Rest of Our Life,” ripped off another song from a pair of Australian songwriters.

According to “The Tennessean,” Australian songwriters Sean Carey and Beau Golden filed the suit against the writers of Tim and Faith’s latest single: pop superstar Ed Sheeran, Snow Patrol’s Johnny McDaid, plus Steve Mac and Amy Wadge, along with the four’s respective publishing companies, claiming “The Rest of Our Life” is bears a close resemblance to their song, “When I Found You.”

Tim and Faith were named in the lawsuit because they are the ones performing the song, although they did not have a hand in writing it. Their record label, Arista Nashville, a division of Sony Music, was also named in the suit.

So why all the hullabaloo? Carey and Golden allege in their lawsuit that, “The two songs are musically similar, while also containing similar lyrics and identical themes of love and marriage.”

And there’s more. “The Tennessean” also reports that there is a personal connection between Sony and the performer of “When I Found You,” a singer named Jasmine Rae. Rae is reportedly in a relationship with a Sony executive, marketing manager Tim Holland, according to the suit.

The lawsuit also alleges that Holland told the plaintiffs that he “frequently works with Sony Music Nashville and communicates with their office as part of his job.”

When Carey and Golden further pushed the issue, Holland allegedly indicated that he was aware that the songs were substantially similar for more than two months before Tim and Faith’s “The Rest of Our Life” was released last October.

The tricky part is that Jasmine Rae apparently didn’t really want to sue Tim and Faith, or Sony, because of the strain that would put on her partner Holland’s career.

“He works directly with the Tim and Faith label team in Nashville,” Rae wrote in an email to Carey and Golden, according to the lawsuit. “Taking such action would compromise both his position and that of the people he reports to, and this is not something I’m prepared to do.” Rae is not a plaintiff in the suit.

The lawsuit alleges the two songs are “substantially similar in bars one through eight of both songs.” “When I Found You” was co-written by Carey and Golden with Rae in 2014 and reportedly achieved commercial success in Australia as the most-played song on the Australian country chart in 2016.

The plaintiffs are asking for a judge to award a permanent injunction blocking the use of the song, and are seeking at least $5 million in monetary damages, according to the newspaper.
